7.84.010 Definitions.

For the purpose of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
"Employee" means any person, other than a massagist, who renders any service in connection with the operation of a massage business and receives compensation from the operator of the business or patrons.
"Massage" means any method of pressure on or friction against, or stroking, kneading, rubbing, tapping, pounding, vibrating, or stimulating of the external parts of the human body with the hands or with the aid of any mechanical electrical apparatus or appliances with or without such supplementary aids as rubbing alcohol, liniments, antiseptics, oils, powder, creams, lotions, ointment or other such similar preparations commonly used in the practice of massage, under such circumstances that it is reasonably expected that the person to whom the treatment is provided or some third person on his or her behalf will pay money or give any other consideration or any gratuity therefor.
"Massage parlor" means any establishment having a source of income or compensation derived from the practice of massage as defined in this section, and which has a fixed place of business where any person, firm, association or corporation engages in or carries on any of the activities as defined in this section.
"Massagist," "masseur" or "masseuse" means any person who, for any consideration whatsoever, engages in the practice of massage as defined in this section.
"Patron" means any person who receives a massage under such circumstances that it is reasonably expected that he or she will pay money or give any other consideration therefor.
"Person" means any individual, partnership, firm, association, joint stock company, corporation or combination of individuals of whatever form or character. (Ord. 82-1049 § 1, 1982)

7.84.020 Prohibited.

Except as provided for in Section 7.84.030, no person shall engage in or carry out the business of massage in the village. (Ord. 82-1049 § 2, 1982)

7.84.030 Exemptions.

This chapter shall not apply to the following individuals while engaged in the personal performance of the duties of their respective professions:
(1) Physicians, surgeons, chiropractors, osteopaths or physical therapists who are duly licensed to practice their respective professions in the state of Illinois;
(2) Nurses who are registered under the laws of this state;
(3) Barbers and beauticians who are duly licensed under the laws of this state, except that this exemption shall apply solely to the massaging of the neck, face, scalp and hair of the customer or client for cosmetic or beautifying purposes;
(4) Certified massage therapists or students who have completed two semesters including not less than four hundred class hours in an approved massage therapy school who are active members of the American Massage Therapy Association or other similar organization whose standards and educational requirements ensure the legitimacy and propriety of the massage rendered, while working under the supervision of any of the professionals set forth in subsection (1) of this section.
(5) Certified massage therapists who are active members of the American Massage Therapy Association and graduates of an American Massage Therapy Association Curriculum Approved School, while associated, as employee or independent contractor, with a health club providing massage therapy within the club confines to daily or full fledged members which said club is licensed by the village, has a full membership in IRSA, The Association of Quality Clubs or the American Physical Fitness Center (APFC) and is an associate member of the American Massage Therapy Association, Inc. 7.84.040 Violation--Penalty.

Every person, whether acting as an individual owner, employee of the owner, operator or employee of the operator, or whether acting as a mere agent or independent contractor for the owner, employee or operator, or acting as a participant or worker in any way directly or indirectly who gives massages or operates a massage parlor or any of the services defined in this chapter in the village or shall violate any provisions of this chapter shall be guilty of a misdemeanor and upon conviction such person shall be punished by a fine not to exceed five hundred dollars or by imprisonment for a period not to exceed six months or by both such fine and imprisonment.
