7.52.010 Soil removal deemed nuisance.

It is a nuisance and against the health and safety of the village of Westchester, Cook County, Illinois, for any owner, lessee or party in possession of any real estate within the village of Westchester to remove or cause to be removed or permit to be removed any soil from any premises situated within the village of Westchester whereby the level of the premises or any part thereof shall be reduced below grade. (Ord. 51-342 § 1, 1951)

7.52.020 Excavation deemed nuisance.

It is a nuisance and against the health and safety of the village of Westchester for any owner, lessee or party in possession of any real estate within the village of Westchester to make any excavation in or upon the real estate whereby the level of any part thereof shall be reduced below grade. (Ord. 51-342 § 3, 1951)

7.52.030 Chapter exceptions.

Nothing herein contained shall be construed as applying to any excavation or removal of soil made in connection with the construction of any improvement on the premises in which such excavation is made or from which such soil is removed. (Ord. 51-342 § 6, 1951)

7.52.040 Filling excavations.

No excavation on any premises affected by this chapter shall be filled in with any material other than black dirt. (Ord. 51-342 § 7, 1951)
