7.04.010 Effect of chapter--Penalty.
Each of the sections of this chapter shall be deemed to state
a misdemeanor or misdemeanors, which, if severally or jointly committed by any
person or persons, or corporation, within the corporate limits of the village,
shall be punished in accordance with the current village penalty provisions.

7.04.020 Assault and battery.
No person shall commit an assault or assault and battery
within the village of Westchester. (Ord. 76 Art. I § 2, 1930)
7.04.030 Breach of the peace.
No person shall provoke a breach of the peace, or shall use
any violent, threatening, profane or indecent language to the disturbance of any
person or persons, or shall use any threatening, reproaching or abusive language
to or concerning any person or persons, tending to provoke a breach of the

7.04.040 Drunk and disorderly persons.
No person shall be drunk, or shall be in a state of
intoxication in any street, avenue or public place, or in any private house or
place to the disturbance of any person or persons. (Ord. 76 Art. I § 4,

7.04.050 Disorderly conduct.
No person shall be guilty of disorderly conduct, or shall
make, aid, countenance or assist in making any improper noise, riot, disturbance
or breach of the peace. (Ord. 76 Art. I § 5, 1930)
7.04.060 Lewdness and indecency.
No person shall be guilty of open lewdness, disorderly
conduct, or act of public indecency, tending to debauch the public morals. (Ord.
76 Art. I § 6, 1930)
7.04.070 Firearms--Discharge.
No person shall fire or discharge any cannon, gun, fowling
piece, pistol or firearms of any kind or description, or fire, explode, or set
off any firecrackers, or anything containing powder or other explosive
substances within the limits of the village of Westchester. (Ord. 72-810 §

7.04.080 Disturbance of worship.
No person shall, by menace, profane swearing, vulgar
language, or any disorderly or unusual conduct, interrupt or disturb assembly of
people met for the worship of God. (Ord. 76 Art. I § 8, 1930)
7.04.090 Disturbance of lawful assemblage.
No person shall wilfully interrupt or disturb any school, or
other assembly of people, met for a lawful purpose. (Ord. 76 Art. I § 9,
1930)
7.04.100 Indecent exposure.
No person, for the purpose of bathing or otherwise, shall
appear in any public place in a state of nudity, or in a dress not belonging to
his or her sex, or in any indecent and lewd dress, or make any indecent exposure
of his or her person. (Ord. 76 Art. I § 10, 1930)
7.04.110 Houses of ill-fame and prostitution.
No person shall keep or maintain a house of ill-fame or
assignation, or place for the practice of prostitution or lewdness. No person
shall patronize or be an inmate of the same, nor let, own or be interested in
any house, room or other premises for any such purpose, or shall keep a common,
ill-governed, disorderly house to the encouragement of idleness, gaming,
drinking, fornication or other misbehavior. (Ord. 76 Art. I § 12,

7.04.120 Lewd exhibition.
No person shall instigate, cause or procure, or in any manner
assist in any indecent exhibition of any animal, or shall exhibit or perform any
indecent, immoral, or lewd play or show, or representation of any kind. (Ord. 76
Art. I § 13, 1930)
7.04.130 Cruelty to animals.
No person shall overload, overwork, cruelly beat, ill treat,
torture, mutilate, or cruelly kill any animal, or knowingly allow the same to be
done. (Ord. 76 Art. I § 14, 1930)
7.04.140 Dog, prize or other fights.
No person shall instigate, cause or procure any dog fight,
prize fight, cock fight, nor any public or private fighting. (Ord. 76 Art. I
§ 15, 1930)
7.04.150 Injuring public property.
No person shall negligently or wilfully injure, destroy, or
deface any bridge crossings, sidewalks, lamp, lamppost or other property of the
village. (Ord. 76 Art. I § 16, 1930)
7.04.160 Lotteries.
No person shall vend, give away, or otherwise dispose of any
lottery ticket, or conduct any lottery. (Ord. 76 Art. I § 17,
1930)
7.04.170 Betting tricks.
No person shall manage, use or practice any trick,
sleight-of-hand game or device whatever with the intent of winning or procuring
the property or money of another person, by inducing him or her to bet, loan or
deposit, or stake money or property upon the result of such trick or game. (Ord.

7.04.180 Dangerous animals at large.
No person shall knowingly suffer or permit any dangerous,
unruly, fierce or mischievous animal, being the owner or keeper thereof, to run
at large, to the danger, annoyance or damage of any other person. (Ord. 76 Art.
I § 19, 1930)
7.04.190 Dangerous sports.
No person shall at any place in the village, fly kites, throw
stones or other hard substances, play ball, or engage in any sport or exercise
likely to injure persons or property, or obstruct traffic or otherwise interfere
with the business of other persons. (Ord. 72-810 § 4, 1972: Ord. 76 Art. I

7.04.200 Burying dead animals.
No person shall allow any dead animal, being the owner or
keeper thereof, to remain within the corporate limits of the village. (Ord. 76
Art. I § 21, 1930)
7.04.210 Obscene marking on walls or structures.
No person shall write, print or paint with chalk, ink, paint,
or other material, any obscene words, language or expression, upon any building,
tenement, fence, wall or other place, or draw, or paint on the same any picture
or representation of anything of an immodest or vulgar character. (Ord. 76 Art.

7.04.220 Obstructing public places.
No person shall, with other persons, congregate about or upon
any stairway, doorway, window, or in front of any business or dwelling house,
theater, lecture room, church, or elsewhere, and by so doing obstruct or
interfere with the free passage of persons entering or occupying any such
buildings or premises, or by his or her language, conversation or conduct,
annoy, insult or disturb persons passing along the streets or alleys, or
occupying, residing or doing business in any of said houses or places. (Ord. 76

7.04.230 Noisy dogs.
No person shall, in the village, keep dog, whelp, bitch, or
other animal shut up or tied up in any yard, house or other place which, by
barking, howling, or by other noises, shall disturb the peace and quiet of any
family, individual or neighborhood. (Ord. 76 Art. I § 24, 1930)
7.04.240 Rubbish in public places.
No person shall place or cause to be deposited on any street,
avenue, alley, sidewalk or public grounds of the village, any manure, filth or
any substance emitting an unwholesome or offensive smell, or any trash, old
iron, brickbats, ashes, chunks of wood, old tin or tinware, old boots or shoes,
wood, brush, straw, paper, tin cans, or other rubbish. (Ord. 50-315 § 1,

7.04.250 False alarm of fire.
No person shall wilfully make a false alarm of fire by
outcry, or by using any bell or other sounding instrument; nor shall any person
make any false alarm of any kind calculated to disturb the peace of the village.

7.04.260 Aiding escape of prisoners.
No person shall aid, abet or encourage the rescue or escape
from prison of any person legally committed thereto, or shall supply, or attempt
to supply, any such person with any weapon or intoxicating liquors, or with any
implement or means of escape while in prison or in the legal custody of any
officer of the village. (Ord. 76 Art. I § 27, 1930)
7.04.270 Defacing posted matter.
No person shall wilfully and maliciously tear down, mutilate
and deface, or render illegible any notice, handbill or poster lawfully posted
upon any street, avenue, alley or other place in the village. (Ord. 76 Art. I
§ 28, 1930)
7.04.280 Impersonating officer--Interfering with officer.
No person shall falsely represent himself to be an officer of
the village, or shall, without being duly authorized, exercise, or attempt to
exercise any of the duties, functions or powers of a village officer; or shall
hinder, obstruct, resist or otherwise interfere with any village officer in the
discharge of his official duties, or attempt to rescue from such officer any
person in his custody. (Ord. 76 Art. I § 29, 1930)
7.04.290 Refusal to aid officer.
No person shall refuse to aid in the arrest of any offender
when ordered to do so by a village police officer or any peace officer of the
village. (Ord. 76 Art. I § 30, 1930)
7.04.300 Obstructing sidewalks.
No person, firm or corporation shall place or cause to be
placed any box, post, sign, bicycle rack or any other article, that can or may
obstruct walk in the village of Westchester, or obstruct the passage of vehicles
upon any street, avenue or alley in the village, except by permission and
license, issued by the president of the board. (Ord. 72-810 § 7, 1972: Ord.

7.04.310 Mendicants--Vagrants.
It is unlawful for mendicants or vagrants to frequent any
store, street, alley, sidewalk, park or other place publicly frequented in the
village. Any person found sleeping in any such place, and who has not any
established domicile or residence, shall be considered to be a vagrant. (Ord.
72-810 § 8, 1972: Ord. 76 Art. I § 34, 1930)
7.04.320 Misrepresentation of age by minor.
It is unlawful for any minor to obtain any intoxicating
liquors from the proprietor of any place of business within the village of
Westchester, or his agent or employee, under the false pretense of being then of
age. (Ord. 72-810 § 9, 1972: Ord. 76 Art. I § 35, 1930)
7.04.330 Clinging to streetcars and trains by minors.
No minor shall climb, jump upon, or cling to, or in any way
attach himself or herself to, any automobile, truck, bus, railway train, or
vehicle of any kind, while the same is in motion. (Ord. 72-810 § 10, 1972:
Ord. 76 Art. I § 36, 1930)
7.04.340 Killing wild birds and squirrels.
No person shall, by the use of firearms, bow and arrow,
slingshot, blow or air gun, pelting with stones, or otherwise, kill or wound, or
attempt to kill or wound, any squirrel or bird, within the village limits, or
shoot an arrow or other missile, or throw a stone, club or other thing, at any
such squirrel or bird, within any private grounds, public parks, squares or
grounds (such squirrel or bird not being the property of the person so
offending), or enter upon any private enclosure, or public ground belonging to
the village, for the purpose of doing any act prohibited in this section. (Ord.

7.04.350 False alarm to police or fire department.
No person shall wilfully make or send in any call or alarm
for the fire or police department unless there be sufficient and bona fide cause
therefor. (Ord. 72-810 § 12, 1972: Ord. 76 Art. I § 38,

7.04.360 Breaking street lights.
No person shall wilfully damage or break the electric or any
other street lights in the village of Westchester. (Ord. 76 Art. I § 39,
1930)
